Hello ive just recently switched over from JSA to IS because i was told i had to

at 29weeks pregnant, i am now 31weeks pregnant and have just been told that i can't claim income support because they wish to know more about my nationality when i have given all information asked for, how come? I have yet to look at the form they sent out to me, today.

i am originally from Spain but am half english due to my mother being british,

my mum moved back to england from spain in 94.

yes i have a spanish passport and birth certificate but am entitled to jewel nationality as far as i know but its exspensive for me to have all information translated into english.

I showed them my passport,birth certificate, national insurance number, bank statement etc..like they asked for and answered/showed information the same as i did for JSA

Could it be maybe because i don't have a recent in-date passport and only my baby one?

Surely if i am part of the EEA/EU and have been here since i was born in 25/04/93 i should be able to claim Income support..

They have now left me 3 weeks without money to support myself or my uborn child and having to look towards my mum for food etc. I find it an outrage to treat someone like this, any information/help that can be given is muchly appreciated

Hi Sadie. Welcome to One Space. Congratulations on your pregnancy. Not long to go now. I'm not sure why you're not entitled to IS, when you have been claiming JS. I would suggest contacting CAB, Citizens Advice Bureau, or you could email our 1-2-1 section  here  They are brilliant at giving advice about money situations. It's completely confidential.

What a nasty shock when you are so near to the baby coming and are trying to sort things out.

Do email the 1-2-1 service as we have had other people in a similar situation and they have all the latest info and the legal position

Me again, i read the letter i received and it says as follows:

 

About your claim for income support

your claim for income support is currently defective. A claim is defective when:

1) As you have provided a copy of your Spanish passport and birth certificate a right to reside has to be considered in your case, can you please fill in the enclosed forms and supply copies of the information requested.

2) In your case you may be able to derive your rights from your parents can you please supply copies of there I.D, any dates worked in UK, if they have any visas/home office docs.

 

The reason that your claim is defective is as follows and this includes the action you must now take for us to consider your claim.

 

Ok so first of all they asked for my information only, no parents I.D etc if they had told me that on the phone i probably wouldn't be in this mess now. i gave the jobcenter/income support the person who sorted out my information in the meeting my original passport and birth certificate and she had copied it not me.

I think that maybe the advisors on the phone should be a little more specific in which documents you need because they did not ask any questions about my parents background on the phone or the meeting.

I think it is bloody unfair how people have to go through this crap when it's the people who can't do their jobs properly that mess it up for everyone else i will be in touch with the person tomorrow to see what i can do etc and hope it all works out in the end.
