Hi all

waiting for decree nisi to be formalised in coming weeks. need to get ball rolling in terms of sorting out finances before decree absolute. mainly its the property where i live with the kids and which ive paid for but unfortunately his name is down as joint owner. 

im not eligible for legal aid and cant afford to pay privately anymore so i will be filling in financial order and submitting it to court. and then assume that the E1 form which looks complicated will need filling in. dont understand the bit about living costs-  estimate etc

has anyone had to do these forms? any advice / tips?

It's a long time since I did this, chocolate81, so can't really speak with any authority as I expect the form has changed.

Two suggestions: email our Legal Expert (click) for some information BUT before doing this, fill in our Budget Calculator (click) so you have some idea where you are batting

I did fill the form in myself but it was 14 years ago so can't remember any of the ins and outs...anyone with more recent experience?

hi guys ive filled in form a (applying for financial order for property adjestment ) and form e -hope ive got it right, going to send them off this week

apparently this process takes ages :(

Well done for completing those forms, I am sure it is a daunting task.

It is natural that you would be nervous about representing yourself in court, it is a big thing to do, but it is something that you are going to do regardless Smile Will a member of your family be going with you?

Hi again chocolate81

The court process I had with regard to this was not too scary, it was a family court like a headmaster's study. Each party had had the opportunity to see the other's form and to ask questions arising. The judge makes a decision based on what is best for the children and takes different things into consideration including each party's earning capacity, they are very experienced and will guide you through

hi ,louise, did u have a solicitor with you? im worried about earning capacity as i earn more than him and hes reduced his hours at work

Hi chocolate I did have a solicitor in the court but I did the form on my own. Earning CAPACITY is what you could earn....not what you earn now. So one of the things you could say is that he has cut his hours down (the judge will see that this was possibly deliberate) There will lots of people who are representing themselves in court now due to the change in the legal aid system so the judge will guode you through.

The most important thing when it comes to any joint home is the children, though, and making sure they have a home.
