Hi

This is hard but ill give it a go, my wife and i split 4 months ago and have the kids a week on and a week off. This has gone fine for me and not for her, i tryed to help at first and always telll them to be good for mummy but evey week she has had a problem.

Now i have a letter stating she wants the kids full time and that my sons behaviour that she has because there is no problem when there with me, means that there better off with her. I'm going to fight this and my girl of 5 boy of 7 tell me how much they love it with me, all i want is 50/50.

can she win this?

Hi D.Abs, welcome to One Space, unfortunately I can't say whether she will win it, however I suggest you start to record in a separate notebook everything that has happened and how it happens.

If the children say positive things about keeping things as they are, write it down and date it. If your ex changes plans or behaves awkwardly write it down and date it. This can be useful in court for the judge to see a bit further than just the case brought before them.

Your children will probably speak to a CAFCASS officer who will ask them what they want and how happy they are, this will all be included in the Court report.

You say that your son doesn't play up when he is with you, however do you think he is misbehaving for your ex wife?
