My daughter is currently completing A Level studies & was 18 in January. Maintenance is paid through tribunal service (ex-husband taken to magistrates court last year as halved maintenance payments). I provided a letter from my daughter's school confirming she is in education and giving course end date as 31st August. Tribunal Service rung school & argued with school about date provided & asked for the date of last exam. Tribunal Service have advised maintenance will end on the 30th June. Information on internet indicates maintenance continues until the end of August in line with Child Benefit I cannot understand how my daughter can make a significant contribution to household until she has her exam results. She must then decide whether to go to uni, return to full-time education if results are not as expected or move into employment. Anyone any experience of this?
Hello chasychew
My own experience of maintainance is that it can go on until the age of 19 provided that the young person is in full-time, non-advanced education. However, it does depend very much on the wording of the order. I suggest that you contact our Legal Expert quoting the wording. You can contact him by clicking here.
It would be good to encourage your daughter to obtain a summer job as this will give her some pocket money (especially important if you cannot fund her much) and also some work experience whatever her career decision in September.
Thank you Louise. I think there is a grey area in determining when full time education ceases as that is the wording on the order. I have e-mailed the legal expert. My daughter has a small part-time job but even if I asked her for all of that it would not cover the cost of her keep and the petrol to run her to and from the job as she does not drive.
Let us know what the expert says
It seems we are talking about an 8 week period discrepancy so I do hope you get the money. I wasn't saying to ask your daughter for her wages really, more that she can top up her own phone etc. The Child Benefit and Child Tax Credit you get for her will continue in the meantime and presumably this is enough to cover her food for that time. I know that's not the point, though, when you were expecting to get the maintenance for another two months and had budgeted for that!
Given that in any case the maintenance will end in two months, it's a really good idea to look forward to how your finances will be as even if your daughter goes off to Uni the household bills will still need to be covered etc. We have budgeting tools to help you make those calculations if you would find that helpful?
Yes indeed an 8 week period where there does not appear to be a clear guideline as to what date full-time education ends.
I would be interested in the budgeting tools please. The order at the time of the divorce also allowed for us to remain in the family home until full-time education ended. I will need to maintain the current house until it can be sold but obviously sooner than originally anticipated.
Hello again
You can find budgeting tools here, here and here (click to see) They take a bit of looking at but remember even if you save a quid or two here and there, this can add up.
It sounds as if you need to think about your housing options as well. Will you be able to buy something small if you sell the house or are you looking at renting?
As a follow up. Child Support legislation states there is a liability whilst Child Benefit is in payment.Ludicrous that i now have to go to the Child Maintenance Service.
Thanks for letting us know that chasychew, sounds a real pain that you have to go to the CSA, hopefully it won't take to long to get it sorted
grateful for assistance with this one
