Has anyone ever been in this situation? I handed in the petition and statement of arrangements to the court and waited for my soon to be ex husbands reply to come, but he has not responded with the acknowledgement part of the form. What do I do next??

According to the internet I can apply to the court (more forms and money!!) for a judge to 1- decide if papers have been served or 2- start the 'directions' for trial. what does that mean??!!

Im not entitled to legal help for this petition and im already paying for a contact order/residency thing so cant afford more legal help. 

has anyone been in this situation?

I eventually had to have a baliff serve the divorce petition on my boys' dad as he refused to acknowledge it. I had had to supply them with all the details I knew of his daily comings and goings in the meantime.

did this cost you alot louise? i emailed the legal expert a few days ago. 

worried as i can see ex dragging this out forever!

how did you arrange a bailiff?

The solicitor arranged the baliff and sadly I cannot tell you how much it cost as it just got lost in the rest of the bill. A solicitor would be able to tell you the cost, but just sit tight for the legal expert first in case there is something cheaper!

hi louise , found out today from local court that it will cost me 105 pounds for court bailiff :(

i dont have legal advice for divorce as im not eligible for legal aid and im already paying a hefty contribution towards contact and residency issues. 

i hope this divorce doesnt take as long as i think it might! what happened to you after the bailiff served papers? did the divorce drag out or was it quite quick?

It went ahead quite quickly after that, chocolate81 although once the decree nisi is granted (first stage) there is a compulsory period of waiting before the decree absolute can be applied for. In my case, my boys' dad then decided to appeal to have the nisi overturned. This is unheard-of and no solicitor would represent him. He withdrew the application the evening before the case was due to be heard (by which time I was climbing the walls with stress) and the decree absolute went through anyway and things were not delayed any further

I am shocked at the price of the baliff. Are you going to do that?

hi louise, ive had a letter from his solicitor to say that hes received the petition and that he reserves the right to defend the divorce , he wants me to confirm that i wont ask for divorce costs and list of other conditions before he returns the divorce acknowledgement. 

not sure what to do, luckily i dont have to pay bailiff as i have this letter, but im confused about what to do next, about a month ago my solicitor said i wasnt entitled to any help with divorce and then today she said maybe i was but to see her after a week or so when she was less busy. 

i just want it all over with!! can i ask louise after the decree nisi was it pretty strsaightforward to sort out the finances/children? ur ex sounds like mine!

I have to say it wasn't straighforward. The children issue was ok as were fairly amicable about that and also my eldest was nearly nine so I felt as if he was quite able to tell me if things were not good. The money not so, BUT there is a structure in place about the money so the judge will not usually brook any nonsense and my ex was told he would be charged with contempt of court if he did not comply with the format.

I don't know what to say about your ex's letter and you need to be guided by the solicitor BUT the petition she will present to the court will list your grounds for divorce and if he chooses to "defend" it, that is very unusual....I have heard of people presenting a counter petition ie to divorce the other person (and if he does then you might think GOOD and just go along with it)but I don't think this is likely in your case

I know it is annoying and frustrating but you need to wait for her to see if there is any aid available.....and have a look here for more information about the process of divorce, and at the right hand side there are links to info about the processes for money and children

hi yes i did my ex well didnt reply to his but at the same time we were going through for his dv towards me so on the one time he turned up at crown court to put his plea in i paid £120 to have the divorce papers forced on him , this way he couldnt get out of it and had to do it or face arrest . it was hard to get it but the best money spent now looking back
