How's it going with the CSA?

Some people read it, I don't advertise it, I get between 10 and 20 hits a day mostly from random search engine searches.

I send links of the pictures to friends and families sometimes.

My mum went through a stage of reading it a while back.... which felt a tad strange.

And my X reads it sometimes too, I know this as stuff has been mentioned in court in the past and that's the only place it could have come from.. that and the fact that she sometimes leaves nasty 'anonymous' comments from time to time.

Oh your Mum reads it, :lol: , my son is always intrigued as how I know things about him and it is because he puts it on his Facebook.

That must be strange, wondering who is reading your thoughts....... (apart from your ex, of course!)

Mine is found by clicking on the link in my sig... the one to my pics of my kids, that's my blog, at least the photo section of it then if you click on the button near the top that says, errr.. 'blog' then you get to the blog bit :)

Isn't it lovely when you can see things through their eyes? I will never forget my boys' reaction to snow for the first time. Son number One was scared because the view out of the window had changed, number Two just went out and rolled in it

Good luck with the letter lindsay gii! Talking of letters, I am assuming you have had no reply from the grandparents yet? 8-)

Hi am back from 3 days annual leave - funny time to have a holiday - it was freezing cold in york but a beautiful city to visit.

Glad that lindsaygii thinks I know my stuff. It has taken me almost 17 years to get to this point. The trouble with self employed non resident parents is that the csa can use tax returns accepted by HMRC to identify their income and the law relating to HMRC and the CSA don't seem to mesh together. Self employed people are allowed more things against the company profits than the CSA law allows and this is the stumbling block many times-getting the CSA to actually investigate.

It is only by appealing that you have the right to see the infomation used to make the assessment and thereby challenge the figures. Going to a tribunal is a bit scary but the staff do try and put you at your ease and they are there to ensure the law has been applied correctly. They have the power to make people produce information to ensure that the assessments are correct. If information is requested by the tribunal but not produced, they can draw adverse inference from this. If all parties turn up, the judge can ask questions of anyone to get to the truth.

MPs can ask the agency to use accounts instead of tax returns which allows a clearer idea of true levels of income/profit. They can also request that the CSA send in inspectors but the csa will weigh up the "cost to the public purse" of doing so. The CSA do take account of enquiries from MPs but in my experience this can sometimes slow the action on the case down until the enquiry is dealt with.

I can well imagine you are sick to the back teeth of it all, lindsaygii. I agree it is a paltry amount of money and will go nowhere. Ironically, the "public purse" could be a lot better off if more parents without majority care were made to pay up, as only £20 per week maintenance can be paid on top of Income Support and the rest is knocked off pound for pound.

Glad the face to face (or was that farce to farce?) interview went ahead and hope you get the appeal. Is there a time limit for writing the letter?

Hi Louise, yes there is a time limit for requesting an appeal - 28 days after the letter refusing to revise the decision. It is importnant that the deadline isnt missed because you would have to make a request to appeal "out of time" to the Tribunal. You have to tell them why you missed the deadline. Often they do allow the appeal but it is by no means certain and it would be a shame to lose your appeal rights.

With regard to keeping child support I have the following information from the December DWP Touchbase Magazine to share with you all.

From 12 April 2010, child maintenance will be fully disregarded when calculating out of work benefits for parents with day-to-day care for children. This means parents will be able to keep every penny of their child maintenance payments (where it is paid) without it affecting their benefit entitlement.
This is good news for parents with care and will mean more money flowing to low income families. It will also encourage parents to agree a maintenance arrangement as all the money paid will go to the child.
Parents who require impartial information and support about child maintenance should contact the Child Maintenance Options Service. The Child Maintenance and Enforcement Commission offers this service to help parents gain a clear understanding of the options available for arranging child maintenance. The aim is that parents feel informed enough make a decision about child maintenance and act on it. Contact the Options Service on 0800 988 0988.

Hi Louise,

I have spoken to the CSA just to check and they tell me that the onus is on the parent with care to notify the DWP about how much CSA they receive, they will no longer notify them :o . The DWP Touchbase magazine says it is ignored when calculating benefit entitlement. Currently people who work and receive tax credits don't have any child support payments taken into consideration so this is spreading to include those on income support and job seekers allowance.

I remember asking for a full disregard as far back as 1994 and being told this would never happen. When they introduced the disregard I asked for more - like Oliver - and again was told to be grateful or words to that effect and now this ! Progress does take time.

It's snowing here in sunny Sheffield - perhaps we might have a white Christmas? :o

Is there an award for the most perserverance with an annoying organisation around? If so, then you should definitely win it hands down for your incredible tenancity on this one! Well done you, I think the reward starts when they start taking you seriously and realsie you are a force not to be recond with and you sound like you have achieved that already.
Now you can enjoy your xmas and then start hassling them again in the new year. Have you written the appeal letter yet?
I hope you mangage to sleep well at night after that battling all day?!

I hope it is a really nice first xmas for your little one and that everyone there pulls together to make it really special. Do they live far away? Do you have snow with you too?
Here we seemed to have still missed out on the snow but it is very cold. The good thing about having a 1 year old at xmas time is that they like all the paper better than anything instide so it can be very inexpensive!!!
Does that mean you don't have to do any of the cooking etc??
It really feels like the count down is starting now that we are at the 20th Dec and I still have to make it into town unfortunately and I have one more day of work to do too but after that I plan to slow right down.

Hi Lindsay just to say that you may not have to appeal but what if the reopening of the case does not result in a change of assessment. If I were you, I would lodge an appeal anyway. You can always withdraw it. IThe letter does not need to be lengthy but needs to tell them you are not happy with the assessment and the date of the letter notifying you.. I have been at this a long time - csa staff make promises - move on and it could take months for them to complete their action. At least by putting in writing that you are not happy and want to appeal keeps the door open. I realise that xmas is a busy time but honestly I would use the belt and braces approach.
